Why Canadian buyers are looking at Europe for construction plant

The UK and continental Europe carry a deep, well-documented used plant market that turns over faster than the North American fleet market does in places. UK contract-hire companies typically replace excavators, dozers and telehandlers on fixed cycles regardless of condition, so genuinely low-hour machines with full service history come up for sale on a predictable schedule. Against a thinner Canadian used market, the price gap for comparable hours and spec can be significant.

None of that is news to buyers who've already looked at buying used machinery from Europe into Canada as an alternative to US supply. What trips people up isn't finding the machine, it's the border. Canadian import rules for construction equipment are more forgiving than most first-time buyers assume, but a handful of requirements — some administrative, some biosecurity, one genuinely misunderstood duty question — need handling correctly the first time, or the machine sits at a Canadian port racking up demurrage while you fix something homework would have avoided.

The two authorities you're dealing with at the border

Canada Border Services Agency (CBSA) handles tariff classification, valuation and duty: what HS heading your machine falls under, what you owe (usually nothing on the main earthmoving headings, more below), and whether your paperwork supports the declared value. Undervaluation on used equipment is a named audit trigger — more on that below.

Canadian Food Inspection Agency (CFIA) handles biosecurity, under Directive D-95-26. Used construction equipment is squarely within scope: anything that's sat on a site, driven on unpaved ground or worked in a quarry is a soil-contamination risk in CFIA's eyes, and gets inspected accordingly at first point of entry.

Both have to sign off before the machine is released to you. A perfect customs declaration doesn't help if CFIA holds the machine over a soiled undercarriage, and vice versa.

Before you start: Business Number and CARM registration

Two administrative steps that need doing well before the machine ships, not arranged in a hurry once it's on the water.

Business Number with an import/export account: Any commercial importer needs a Business Number (BN) issued by CRA with an import/export (RM) account attached. This isn't your general business registration — it's a specific import account, and it needs to be in place before your first shipment arrives.

CARM Client Portal registration: CARM is now how customs declarations, duties and GST are filed and paid. The detail that catches first-time importers out: the importer must register their own CARM account personally. A customs broker cannot register it for you — they can only receive delegated authority once your account already exists. Release Prior to Payment, which lets the machine be released before duties and GST are finally settled, requires your own financial security posted against your account, not your broker's.

Using a customs broker (recommended, not mandatory): A broker isn't legally required, and experienced importers do file their own declarations. But you remain legally responsible for classification and compliance either way, and a broker who knows heavy equipment catches classification and CFIA-referral issues before they become a hold at the port. Either way, your own BN and CARM registration need to exist first — a broker cannot create either for you.

Customs and duty: what you'll actually pay

This is the section where most of what gets said online is backwards, and it's worth taking slowly.

Canada's Most-Favoured-Nation (MFN) rate is the default rate applying to goods from essentially anywhere, with no trade agreement invoked and no proof of origin required. The headings covering the bulk of construction plant are already MFN Free: heading 84.29 covers bulldozers, angledozers, graders, levellers, scrapers, mechanical shovels, excavators, shovel loaders and road rollers — every subheading. Heading 84.30 covers other earthmoving and pile-driving machinery. Heading 84.27 covers fork-lift and works trucks fitted with lifting equipment, including telehandlers.

What MFN Free actually means: free of duty regardless of where the machine was manufactured. Country of manufacture simply does not enter into it on these headings. A machine built in Japan, one built in Korea and one built in Staffordshire all clear at the same rate — zero — whether or not any trade agreement is invoked.

That has a direct implication for the UK specifically. CETA is the Canada-EU trade agreement — the UK is not in CETA. UK-origin goods travel under the Canada-UK Trade Continuity Agreement, in force since 1 April 2021, and from 1 September 2026 the UK's CPTPP accession also enters into force with Canada. Both agreements are real. But for a used excavator on heading 84.29, neither one does anything for you, because the heading was already free before either was signed.

"European machinery is duty-free because of CETA" has the logic backwards. The duty-free treatment comes from the MFN schedule, not trade preference. Preference only matters on the minority of headings that aren't already MFN Free — the clearest example here is road tractor units for semi-trailers (HS 87.01.21–.29) at 6.1 per cent, which is highway tractor units, not earthmoving plant. If you ever do need to claim preference on a non-free line, remember origin follows where a machine was manufactured, never where it was bought, serviced or repainted — the rules of origin explicitly list cleaning, servicing, repainting and even substantial repair as operations that don't confer origin. A Korean-built machine that's spent five years on a UK dealer's yard is still Korean-origin, and claiming preference on it anyway is a false declaration exposing you to retroactive duty and penalties on verification — real risk for no gain if the heading is already MFN Free.

GST applies regardless of duty outcome. On a commercial import, CBSA collects only the 5% federal GST at the border, charged on the machine's transaction value — not on freight and insurance — and generally recoverable as an input tax credit for a GST-registered business using the machine commercially (Excise Tax Act s.169), confirm eligibility with your accountant rather than assuming it. The provincial part — HST in Ontario and the Atlantic provinces, or PST/QST elsewhere — is self-assessed on the importer's return afterwards, not collected at the border, and is also recovered for a registered business. British Columbia has no HST: a BC-bound machine carries the 5% GST plus a separate 7% PST, self-assessed with the province. A partial exemption may exist under BC Bulletin PST 110 (production machinery), but whether it applies is fact-specific, so check it against your own situation.

None of this removes the need to get the classification right. Tariff classification is the single thing CBSA challenges most often on imported machinery, and sub-headings within 84.29 and 84.30 vary by function and spec. An advance ruling, or at minimum a broker's written opinion, before you commit is cheap insurance against a reclassification dispute later. But the headline holds: for most construction plant crossing from the UK or Europe into Canada, the honest answer on duty is "already free, no agreement needed."

CFIA soil rules and what they mean for earthmoving plant specifically

CFIA Directive D-95-26, 5th revision, effective 1 April 2026, states plainly: "The importation of items contaminated with soil and soil-related matter from all countries is prohibited." The operational guidance is stricter than that sentence suggests — CFIA describes zero tolerance, and "anything more than dust accumulated during transport is considered as excessive amounts of soil."

Earthmoving plant is exactly the category this rule was written for. An excavator, dozer, roller or dumper that's been working a site accumulates soil in every recess by design — track frames, bucket teeth, ripper shanks, axles, undercarriage rollers, inside counterweights. Inspectors check undersides, wheel wells, axles and, in their own phrase, "all nooks and crevices," often using a creeper or an inspection pit.

This matters more for construction plant than most imported goods, because of the on-arrival options. For settlers' effects, diplomatic shipments and some military equipment, a supervised-cleaning route exists at the port if soil is found. That route doesn't exist for commercial shipments. A commercial machine found soiled on arrival is refused entry and ordered removed from Canada, at the importer's expense, covering quarantine, treatment, disposal or removal. There's no on-the-spot fix — the decision is already made once the machine is on Canadian soil.

The practical answer is pre-export cleaning by a professional contractor before the machine leaves Europe, with a documented cleaning record for CFIA and your broker: proper attention to the undercarriage and track frame, wheel arches and axle housings, bucket and attachment pin joints, counterweight recesses and radiator/cooler packs, not just a surface wash of the visible bodywork. A machine that's been through this, with paperwork to show it, clears inspection far faster than one that hasn't — and doing it properly in the UK costs a fraction of what a refused-entry order costs once the machine has already crossed the Atlantic.

Asbestos, emissions and the age question

Two further areas sit outside CBSA duty and CFIA soil rules, worth checking before committing to a specific machine — particularly an older one.

Asbestos: SOR/2018-196, in force since 30 December 2018, prohibits importing asbestos-containing products. Products already in use before 30 December 2018 are excluded from the ban, which on the face of it covers older machines with original brake linings or gaskets — but how the border applies that to an imported used machine is not settled, so we check older machines case by case. Detection mechanics for used plant at the border aren't well documented publicly, so treat it as purchase-time due diligence rather than a routine checkpoint: on any candidate machine, ask about original friction material and replacement history before you buy, not after it ships.

Off-road engine emissions: Off-road diesel engines are regulated under CEPA 1999 (SOR/2020-258), broadly aligned with US EPA tiers. The import declaration must confirm the engine carries a Canadian, US EPA or CARB emissions label — we photograph the engine plate before we quote. Importers also file an ECCC importation declaration with a statement of conformity, and the filing obligations vary with how many engines you bring in over a year — confirm what applies to you rather than assuming a low-volume import is exempt. Whether a specific older machine's engine tier is a genuine issue isn't something this guide can resolve in general terms — confirm the position with a broker for the actual machine and engine, rather than assuming an older engine is automatically barred or automatically fine.

The 15-year rule doesn't apply here. Tariff item 9897.00.00 — the "15-year rule" that trips up used car importers — restricts used motor vehicles, not heavy equipment. CBSA Memorandum D9-1-11 even carves out large off-highway diesel dump trucks (7.2 cubic metre struck capacity or more, 15 tonne payload or more) used at mines, quarries or construction sites from vehicle-import age restrictions. Most self-propelled construction equipment is exempt from Transport Canada's Registrar of Imported Vehicles programme regardless of age, because it's designed strictly for off-road use — a genuinely easier path than importing a car.

What the import actually costs

On the numbers we can state with confidence: GST is 5% of the machine's transaction value — not freight and insurance — generally recoverable as an input tax credit for a qualifying GST-registered business. Only that 5% federal GST is collected at the border; the provincial part (HST in Ontario and the Atlantic provinces, or PST/QST elsewhere) is self-assessed on the importer's own return afterwards. Duty is typically zero on the main earthmoving and lifting headings, for the MFN reasons above. Add broker fees if you use one, port and terminal handling, CFIA inspection costs, and any contamination-related costs if a machine isn't cleaned to standard before shipping. A BC-bound machine carries a separate 7% PST on top of GST, self-assessed rather than collected at the border.

What we won't do is hand you a freight number. There's no reliable published benchmark for heavy-equipment breakbulk, RoRo or flat-rack shipping from Europe to Canada — the range is too wide to be useful, because it depends on the machine's dimensions and weight, the shipping mode, the routing and market conditions at the time you book. Anyone quoting a flat per-tonne or per-container figure without knowing your machine and route is guessing. Get a routing-specific quote once you have a machine identified, and build your landed-cost picture from GST, broker fees and port charges as the parts you can actually plan around.

Undervaluation is worth flagging because CBSA names it as an audit trigger on used equipment specifically. Unlike a new machine, there's no manufacturer list price to check a declared value against, which makes used plant a natural target for scrutiny. Supporting documentation — purchase agreement, refurbishment or repair invoices, service records and, where the value is material, a third-party appraisal — strengthens your filing and reduces the chance of a valuation dispute holding up release.

Getting the machine to site — ports and routing

Halifax and Montreal are the transatlantic gateways for machinery arriving from the UK and Europe; Vancouver is the west-coast gateway. Prince Rupert is an Asia-facing port served by rail and isn't a realistic entry point for a European shipment.

For a contractor based in British Columbia or further west, that's a genuine routing decision: ship via the Panama Canal direct to Vancouver, or discharge on the east coast at Halifax or Montreal and move the machine west by rail. Which makes sense depends on the machine's dimensions, sailing schedules at the time, and cost — and as above, that cost is quote-specific rather than something a general guide can put a number on. Get quotes for both routings rather than assuming west-coast is automatically cheaper just because it's geographically direct.

Whichever port the machine lands at, your CFIA referral and CBSA release happen there, so it needs to be a port your broker actually operates through — worth confirming before you commit to a routing.

What to check when buying used construction plant from Europe

Beyond the border process itself, a few things are worth knowing about the UK and European used plant market, whether you're buying direct or working with a buying agent sourcing construction machinery into Canada on your behalf.

Contract hire history is a genuine advantage. A large share of UK excavators, dozers and telehandlers come off structured plant-hire fleets on fixed replacement cycles, with full dealer-maintained service history regardless of the machine's actual condition — a materially different provenance from a machine that's changed hands privately several times with patchy paperwork, and worth paying a premium for.

Hours don't tell the whole story. An excavator that's spent its life on soft groundworks wears differently from one that's done equivalent hours on hard demolition or quarry work. Ask what the machine actually did, not just how many hours are on the clock.

UK vs continental spec. UK machines are built to the same core standards as continental European equipment, but check hydraulic coupling types, attachment mounting standards (genuine ISO/CW-type quick couplers versus manufacturer-proprietary systems) and cab configuration against what you're actually planning to run in Canada.

Undercarriage condition drives both value and CFIA risk. Track pad wear, roller and idler condition affect resale value directly, and a worn or heavily soiled undercarriage is exactly where a CFIA inspection looks hardest. A pre-purchase inspection checking both condition and cleanliness saves problems at two separate points in the process.

Do I have to pay customs duty on used construction equipment imported to Canada from Europe?

Usually not, and it's nothing to do with a trade agreement. The headings covering most construction plant — 84.29 (bulldozers, graders, excavators, shovel loaders, road rollers), 84.30 (other earthmoving equipment) and 84.27 (fork-lift and works trucks, telehandlers) — are already Most-Favoured-Nation Free in the Canadian Customs Tariff: free of duty from any country of manufacture, no trade agreement or proof of origin needed.
